Terms of Use

Last Updated: November 6, 2026

These Terms of Use ("Terms") form a legally binding agreement between you and P50 Digital LLC governing your use of Home Internet Near You (https://homeinternetnearyou.com) and related services. If you do not agree, you may not use the Service.

Please read carefully. These Terms include a binding arbitration agreement and class action waiver (Section 16). By using the Service, you agree to all terms below.

1. Overview

These Terms are a legally binding agreement between P50 Digital LLC, on behalf of itself and its parent, subsidiary, and affiliate companies (collectively, "Company," "we," "us," or "our"), and each visitor, user, or customer (each, "you") of our website at https://homeinternetnearyou.com and any affiliated websites, subdomains, mobile versions, and online media under our operation and control (collectively, the "Service").

By accessing and using the Service, you acknowledge that you have read and understand these Terms and our Privacy Policy; that your continued use of the Service constitutes acceptance of these Terms; and that you are at least eighteen (18) years old or the age of majority in your jurisdiction. The Service is not intended for children under sixteen (16).

Authorized Retailer Disclaimer

Home Internet Near You is operated by P50 Digital LLC, an independent authorized retailer and marketing platform. We are not an internet service provider, and we are not affiliated with, endorsed by, or acting on behalf of AT&T, T-Mobile, Spectrum (Charter Communications), Xfinity (Comcast), Frontier, Starlink (SpaceX), or any other provider unless expressly stated in writing. All provider names, trademarks, and service marks are the property of their respective owners and are used only to identify their services. When you call a number on the Service, you will speak with a Company representative or an authorized retailer, not the provider itself.

2. Provider, Coverage, and Price Information

The providers shown, their order, and coverage estimates are based on public U.S. Federal Communications Commission broadband data and on an estimate of your general location from your IP address or the ZIP code you enter. Coverage percentages describe an area, not your address. Availability, speeds, prices, promotions, and terms are set by each provider, vary by address, may require Auto Pay, a voice line, or other qualifying services, may exclude taxes, fees, and equipment charges, and can change at any time without notice. The ranking and "Top pick" label reflect coverage in the area shown and our business relationships; they are not a guarantee or endorsement. Service is confirmed only when you place an order with the provider or its authorized retailer.

3. Changes to the Service and Terms; Testing

We may modify these Terms or the Service at any time. Material changes will be reflected in the "Last Updated" date above and become effective upon posting. Your continued use of the Service after a change constitutes acceptance of the revised Terms. We may test features, layouts, pricing, offers, or functionality at any time, and may include or exclude users from such tests without notice.

4. Privacy

Use of the Service is subject to our Privacy Policy, which describes how we collect, use, share, and sell your Personal Information and how you can opt out of its sale or sharing.

5. Calls, Text Messages, and Consent

Calling us. When you call a number shown on the Service, you agree that the call may be recorded and monitored for quality, training, and compliance, and that we may record the number you call from and match it to your visit.

Asking us to call you. When you submit a request for a call on the Service, you provide your electronic signature and expressly consent to receive calls and SMS/MMS text messages — including those made using an automatic telephone dialing system or an artificial, prerecorded, or AI-generated voice — from Company and the companies named in the consent language shown with the request, about the services described in that consent, at the phone number you provide, and emails at the email address you provide, even if your number is on a federal, state, or company Do Not Call list.

Consent is not a condition of any purchase. Message frequency varies; message and data rates may apply. You may revoke consent at any time by any reasonable means, including by replying STOP to any text message, using the unsubscribe link in any email, telling a caller you do not want further calls, or emailing [email protected]. Reply HELP for help. You confirm that the phone number you provide is your own or one you are authorized to use, and you agree to tell us promptly if you give up that number.

Consent Records

You agree that Company may keep records of your consent — including the date and time, the consent language shown to you, IP address, browser and device information, the page you were on, and consent certificates where used — and may share those records with providers, Marketing Partners, our service providers, courts, and regulators to show that you consented.

Third-Party Offers

Providers, their authorized retailers, and Marketing Partners are independent companies. They are not our agents, and we are not responsible for their products, services, communications, or privacy practices. Any purchase you make from them is solely between you and that company and is subject to its own terms.

6. Ownership of Content

All content available through the Service — including text, graphics, layouts, logos, software, and the design and arrangement thereof — is owned by Company or its licensors and is protected by U.S. and international intellectual property laws. Content is provided for personal, non-commercial use only. No commercial reuse, reproduction, modification, distribution, or display is permitted without our prior written consent.

7. Usage Rules

You agree not to:

8. Trademarks

Trademarks, service marks, and trade names displayed on the Service are owned by Company or their respective owners and may not be used without express written permission. Nothing on the Service grants any license or right to use any trademark.

9. Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by Company without compensation, attribution, or restriction.

10. Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without cause or notice. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, limitations of liability, and Section 16.

11. Indemnification

You agree to defend, indemnify, and hold harmless Company and its affiliates, officers, directors, employees, contractors, agents, and licensors from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any information you submit through the Service.

12. Disclaimer of Warranties; Limitation of Liability

The Service and all content, including provider, coverage, and price information, are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or reliability. Company does not warrant that the Service will be uninterrupted, secure, or error-free, or that any provider or price shown is available at your address.

To the maximum extent permitted by law, in no event shall Company or its affiliates, officers, employees, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service. Company's total cumulative liability to you for any claim shall not exceed fifty U.S. dollars ($50.00).

13. Third-Party Links

The Service may link to third-party websites or services that we do not own or control. We are not responsible for their content, privacy practices, or actions.

14. Geographic Disclaimer

The Service is intended for use in the United States only. Those who access it from elsewhere do so on their own initiative and are responsible for compliance with local laws.

15. Choice of Law

These Terms and any dispute arising out of or relating to them are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to Section 16, any judicial action shall lie exclusively in the state or federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts.

16. Binding Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms, the Service, or any communications from Company (a "Dispute") shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules and, where applicable, its Consumer Arbitration Rules. Arbitration shall take place in Florida unless you and Company agree otherwise. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

You and Company agree that each party may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. If this class action waiver is held unenforceable, the entirety of Section 16 shall be null and void, but the remainder of these Terms shall remain in full force.

This Section 16 also applies to any Dispute relating to calls, text messages, or emails sent by Company or by any company named in your consent in reliance on the consent you provided through the Service, and those companies are intended third-party beneficiaries of this Section 16 for that purpose. Either party may bring an individual action in small claims court if the dispute qualifies, and either party may seek injunctive relief in court to protect intellectual property rights.

17. Right to Notify Law Enforcement

We may, at our sole discretion and without notice to you, report suspected unlawful activity to law enforcement and cooperate with any related investigation, including by disclosing your information.

18. Entire Agreement; Severability; Assignment; Waiver

These Terms, together with our Privacy Policy and any additional terms disclosed with specific features, are the entire agreement between you and Company concerning the Service. If any provision is held unenforceable, it shall be enforced to the maximum extent permitted, and the remaining provisions remain in full force. We may assign these Terms at any time without notice; you may not assign them without our prior written consent. No failure or delay by Company in exercising any right operates as a waiver of that right.
